1. Personal data

This Privacy Policy sets out Mediaco's commitments regarding the protection of your Personal Data in your capacity as a user of the services. It presents the modalities of collection and use of your personal data as well as your rights in this respect.

In general, you can visit the Mediaco website without providing any personal information about yourself. In any case, you are in no way obliged to transmit this information to Mediaco.

Nevertheless, in case of refusal, you may not be able to benefit from certain information or services that you have requested. In this respect, Mediaco may in some cases ask you to provide your surname, first name, e-mail address, telephone number, company and function. By providing this information, you expressly accept that it will be processed by Mediaco, for the purposes indicated in point 3 below.

General aspects

This Privacy Policy may change in accordance with applicable laws and regulations. It applies in addition to the General Conditions of Use.

Below you will find all our commitments in terms of confidentiality, security and protection of the personal information you provide to us. The purpose of this Privacy Policy is to provide simple, clear and complete information about the processing of your Personal Information by Mediaco. Mediaco attaches the greatest importance and care to the protection of privacy and personal data.

Mediaco respects the law "Informatique et Libertés" n° 78 of 6 January 1978 modified, the law for the "Confiance et l'Economie Numérique" n° 2004 - 575 of 21 June 2004 as well as the General Data Protection Regulation 2016/679 of 27 April 2016 ("GDPR").

1. Definitions

The terms mentioned below have the following meaning in this Privacy Policy:

DATA CONTROLLER: Refers to the entity that determines the means and purposes of a processing of Personal Data

SUBCONTRACTOR : Refers to the entity processing Personal Data on behalf of the DATA CONTROLLER, acting under the authority and instruction of the DATA CONTROLLER.

USER: Refers to the person whose data is processed by Mediaco through his/her registration on the site.

PERSONAL DATA: Personal Data: Personal Data is any information relating to an identified or identifiable natural person, i.e. a person who can be identified, directly or indirectly, by reference to an identification number or to one or more factors specific to that person.

PROCESSING OF PERSONAL DATA: Processing of Personal Data: Any operation or set of operations relating to such data, whatever the process used, and in particular the collection, recording, organisation, storage, adaptation or modification, extraction, consultation, use, communication by transmission, dissemination or any other form of making available, reconciliation or interconnection, as well as the blocking, erasure or destruction, shall constitute processing.

2. Identity of the controller

Mediaco is the entity that acts as the data controller in the sense of the applicable regulations on personal data and in particular the RGPD. Mediaco is a public limited company with a board of directors, registered under the number 32579356000021 and with its registered office atEspace Jean-Jacques Vernazza 17 avenue André Roussin 13016 Marseille, France.

3. Purposes and legal bases of the processing

The purposes for which your personal data is processed are specified to you when the data is first collected, usually in a "Protection of personal data" section on the collection medium. Your personal data will not be processed after collection in a way that is incompatible with these purposes or for other purposes without first providing you with information about these new purposes.

Mediaco may process your personal information:

(a) for the purpose of collecting information to help us improve our Site, products and services (including through the use of cookies); and/or

In any case, and for each defined purpose, Mediaco will do everything in its power to ensure the security and confidentiality of the personal data entrusted to them, in compliance with the laws and regulations in force.

4. Data collected

When you provide some of your personal data through the collection forms, the mandatory fields are indicated, either literally or by asterisks: you will have to provide the corresponding information in order to be able to use the service offered or to benefit from the processing of your request.

Whatever the method of collection, Mediaco undertakes to inform you of the purposes of the processing, the recipients of the data, the existence of your rights and how to exercise them.

5. Data security

In any case, and for each defined purpose, Mediaco will do everything in its power to ensure the security and confidentiality of the personal data entrusted to it, in compliance with the laws and regulations in force. All processing carried out by Mediaco is secure and confidential. Only authorised persons have access to your personal data. The data is processed and stored on a secure server located in France at a certified health data host (HDS).

Our employees are aware of the need for confidentiality and we demand a high level of data protection when selecting our subcontractors and partners.

In the event of a data breach or any request to exercise rights from an end-user of our solution, we must alert you in order to take the necessary measures and follow the appropriate procedure.

6. Recipients of the data

Only Mediaco is the recipient of your personal information. This information, whether in individual or aggregated form, is never transmitted to a third party, notwithstanding the subcontractors that Mediaco uses (you will find more information about them in point 7 below). Neither Mediaco nor any of its subcontractors market the personal data of visitors and Users of its Site.

7. Duration of data retention

Your Personal Information is kept by Mediaco only for the time corresponding to the purpose of the collection as indicated in 3 above, which will in any case not exceed 24 months.

8. Transfer of Personal Data outside of the European Union & Authorised Providers

Mediaco informs you that it has recourse to its authorised service providers to facilitate the collection and processing of the data that you have communicated to us. These service providers may be located outside of the European Union and have access to the data collected through the various forms on the Site (with the exception of the form allowing you to exercise your rights to information technology and civil liberties, which is offered and operated by Mediaco).

Mediaco has previously ensured that its service providers provide adequate guarantees and comply with strict conditions regarding confidentiality, use and data protection. In particular, vigilance has been exercised with regard to the existence of a legal basis for any transfer of data to a third country. In this respect, one of our service providers is subject to internal company rules (or "Binding Corporate Rules") which were approved by the CNIL in 2016, while the others obey not only Standard Contractual Clauses but also the Privacy Shield.
